Terms and Conditions
myndpark is an Australian Business, ABN 12 667 712 072, and can be contacted via email through our Contact form on our website (https://myndpark.com/contact).Your Wellbeing Strategy, Your Wellbeing Strategy Mini and Your Wellbeing Strategy Session are collectively referred to in these Terms and Conditions as “YWS”. By booking into YWS, you indicate your acknowledgment and acceptance of these Terms and Conditions, further referred to as “T&Cs”.These T&Cs are subject to change by myndpark at any time at its discretion. Your continued participation in YWS constitute your acknowledgment and acceptance of these changes. Please consult these T&Cs regularly.
What is YWS?
YWS is a type of wellbeing coaching, which thoughtfully combines multiple therapeutic, counselling, somatic and coaching modalities to assist you to achieve your desired wellbeing outcomes. Engaging in YWS means entering a professional, contracted relationship, the terms of which are specified in these T&Cs. YWS is a comprehensive process that may involve making changes to all areas of your life, including work, finances, health, relationships, education and recreation. By registering for YWS, you acknowledge that YWS may involve invitations to challenge your current thinking and behaviour patters and that uncomfortable feelings may arise as a result of YWS. At myndpark, we believe that discomfort is a sign of growth and is an essential step in personal transformation.
By engaging in YWS, you acknowledge that you are fully responsible for the decisions you make about your life and behaviour, both during and after the sessions. You further understand that you are fully responsible for your physical, mental and emotional wellbeing during the sessions and will promptly raise any wellbeing concerns with myndpark staff. myndpark staff conducting the YWS sessions are formally trained in counselling and coaching and we do our very best to support your wellbeing. However, the ultimate responsibility for your wellbeing is with you and we expect you to request changes, if something is not working for you. myndpark is happy to adjust our coaching approach, but first we need your input. At myndpark, we want you to have a wonderful experience in YWS. We expect you to share any constructive feedback with us during the coaching process, so that we can promptly make adjustments.
Privacy and Confidentiality
As part of booking YWS, you agree that personal information about you will be collected. You understand that as part of providing a service to you, myndpark may need to use digital tools, such as video conferencing software, transcribing and note taking software. You understand that your personal information may become available to these external parties, that it will be treated confidentially and will be used only for the purposes of myndpark providing a service to you, as specified in these T&Cs. You understand that there are certain circumstances where myndpark may be required by law to disclose your personal information, such as when there is a risk to a person’s life or when ordered by a court to do so. You understand that myndpark will attempt to communicate it to you, if your personal information is required to be shared by law.
You understand that information and resources provided to you during YWS include proprietary information, owned by myndpark, and are provided to you solely for your own personal growth and development. You understand that using information, techniques and resources provided to you for any other purpose, other than personal non-commercial use, are a breach of myndpark’s Intellectual Property rights. Information, techniques and resources provided to you may not be used or transmitted to others as your own work, under any circumstances. You further understand that you do not have permission to record or in any other way transmit YWS live sessions to others. You acknowledge that you do not have permission to transmit any parts of YWS, including voice note coaching, to other people. Specifically, forwarding of the voice note coaching messages or sharing them on social media platforms is prohibited.
You understand that you may request a copy of information that myndpark holds about you at any time. You understand that you may request correction of your personal information, if it is wrong. You understand that YWS live sessions will be transcribed, using Heidi, an Australian Privacy Principles compliant meeting transcription software. Using this software allows myndpark staff to focus entirely on you throughout YWS, while at the same time having accurate notes and to assist in the preparation of your Wellbeing Action Plan.
Cancellation, Rescheduling and Refund Policy
By booking a session, you confirm your understanding and acceptance of myndpark’s Cancellation, Rescheduling and Refund Policy, outlined herein. Session fees must be paid in full at time of booking to secure your appointment.
More than 48 hours before your scheduled session, appointments can be rescheduled at no additional charge. If a cancellation is requested more than 48 hours before a session, a full refund will be provided to the original payment method. If cancellations are made less than 48 hours prior to an appointment, the full appointment fee will be charged. Requests to cancel and reschedule appointments must be submitted via return email in the original booking at least 48 hours prior to your appointment.
What is included?
There are 3 types of Your Wellbeing Strategy packages. For Your Wellbeing Strategy, you will receive 3 weeks of voice note coaching, your Wellbeing Action Plan sent to you within 24 hours of your first session and 3 x 90-minute sessions booked within a 3 week period.
For Your Wellbeing Strategy Mini, you will have access to 90-minute YWS session, a Wellbeing Action Plan sent to you within 24 hours of your YWS session and a week of access to voice note coaching, as per Voice Note Coaching section of these T&Cs. For Your Wellbeing Strategy Session, you will receive a 90-minute coaching session.
Your outcomes from YWS depend on you! myndpark staff will provide you with information, resources, strategies. The role of myndpark is to clarify your goals, challenge your thinking patterns, help you see your situation in a new way. myndpark is unable to guarantee your results as you are the only person who can create change in your life. If you are unsure if YWS is right for you, you are invited to complete the Coaching Quiz and you will receive personalised insights and recommendations.
Format
YWS runs via online video conferencing software, Zoom. You need to install the free Zoom app, prior to YWS. Please note that using Zoom in the browser can lead to technical issues. You will need to ensure that your camera and audio are working prior to the session and that you have a stable internet connection. If you have ongoing issues with turning on the sound or video during the session, the session may be discontinued, if alternative means of communication are not available. If the session is discontinued due to your technical issues or internet connection, the session fee will not be refunded and cannot be credited towards a future booking. It is in your best interest to ensure audio and video are working and to have a back-up internet connection device, such as hotspot on mobile.
Duration
YWS session duration is 90 minutes. This includes 2 x 40 minute sessions with a 10 minute break in the middle. If you arrive late to a session, additional time will not be provided at the end of the session and the session will still end on time. The meeting room will open exactly at the session time.
Voice note coaching
Your YWS package may include voice note coaching. To access voice note coaching you will need to install the Signal app – a secure messaging and voice messaging software. This is the only app that can be used for YWS voice coaching. If you are unable to download or use this app, you will not be able to take part in voice note coaching.
The purpose of YWS voice note coaching is to support you in implementing your Wellbeing Action Plan. Being concise with your voice notes and asking a specific question will be most beneficial. Voice note coaching is not the place to vent about your day, but to reflect on how you’re going with implementing your Wellbeing Action Plan. To support you with staying focused, the guidance for each voice note message you send is to be under 5 minutes, with a maximum allowable daily total message time of 15 minutes. Your voice note will be replied to as soon as possible, within 24 hours, if sent on Monday, Tuesday, Wednesday or Thursday and within 48 hours, if sent on Friday, Saturday, Sunday or a public holiday in Melbourne, Australia.
Voice note coaching can begin immediately after YWS and end at the end of the 6th day after your YWS live session (for Your Wellbeing Strategy Mini) and will end after 3 weeks (for Your Wellbeing Strategy). To take part in voice note coaching, you will need to scan the QR code emailed to you on the day of your first YWS live session, get the Signal app and send your first voice message to a myndpark staff member, whose details will be within the QR Code. Please note that myndpark will not message you first to arrange voice note coaching. The opportunity to reach out is yours. Any messages received via voice note after voice note support end date will not be responded to.
Force Majeure
In the rare event that YWS cannot take place due to a personal emergency of myndpark staff, such as illness, or due to a technical issue, such as failure of the online video conferencing platform and no mutually suitable alternative can be found, the client will have the option to re-schedule the session for another day at no additional cost or to receive a full refund of the session fee.
In no circumstance, will myndpark be held liable for YWS being cancelled, due to circumstances beyond myndpark’s control, such as natural disasters, weather, acts of government, strikes, lockouts or other industrial disturbances, blockades, wars, insurrections or riots, epidemics, pandemics, government restrictions, landslides, fires, storms, floods, explosions or other similar causes beyond the control of myndpark. In these case, full or partial refunds of session fees or granting of credit vouchers, shall be at myndpark’s sole and absolute discretion and will only be provided in the event that such refunds or credit vouchers do not detrimentally impact myndpark’s legitimate business interests.
Testimonials and Feedback
At the conclusion of YWS you may choose to provide video, photo, audio and/or written testimonials and/or feedback about your experience. Please note that by providing feedback or a testimonial, you grant myndpark a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable licence and authority to use the material you provide for myndpark’s legitimate business purposes, including but not limited to promotion, marketing, website design and digital product creation. Each testimonial and piece of feedback provided to myndpark via any means is treated as a Submission and is treated according to myndpark’s Terms and Conditions.
